Why importers use Opscale Exchange
Built for U.S. importers of record who filed for IEEPA refunds, through CAPE, protest, or litigation, and need cash sooner than CBP will pay.

Non-recourse, except for fraud
If CBP delays, reduces, or denies your refund, you don’t repay the advance, as long as your representations are accurate. The capital partner is taking that risk, not you.

All refund paths are placeable
Pricing reflects expected timing. The longer the wait for CBP, the closer to the lower end of the range, but you don’t have to wait for it.
Path 1
CAPE refunds
Typical wait for CBP: 60–90 days from CAPE acceptance, sometimes longer depending on processing.
Prices toward the top of the 88 to 92 cent range
Path 2
Protest or litigation
Typical wait for CBP: 12 months or longer for CBP Form 19 protests or Court of International Trade litigation.
Prices toward the lower end of the range, still placeable
Frequently asked questions
If something isn’t covered here, submit your intake and our call center will walk you through it on the first call.
Does Opscale Exchange buy my refund?
No. We connect you with capital partners who purchase the refund receivable. Opscale Exchange does not buy it.
How fast is this, really?
Most purchases fund 5 to 10 business days after intake, often sooner. The biggest variable is how quickly your documents come in during underwriting.
How much will I receive for my refund?
Capital partners pay 88 to 92 cents on the dollar to purchase your refund, depending on when CBP is expected to pay. The capital partner sets the final purchase price in its offer.
What happens if CBP delays, reduces, or denies the refund?
The purchase is non-recourse except for fraud. As long as your representations are accurate, you owe nothing back. The capital partner carries that risk.
What does this cost me?
There is no separate fee to you. The capital partner’s pricing is built into the purchase price, and you can decline any offer.
What documents do I need to submit?
Your refund filing plus standard underwriting: financial statements, A/R and A/P aging, bank statements, a debt schedule, and ownership information.
Does my customs broker stay involved?
Yes. Your broker’s work does not change. We work from the filing you already have.
What if my refund is already pledged to a lender or factor?
Note it on your intake. An existing lien has to be released or subordinated before a capital partner can purchase the refund, and we will walk through that on the first call.
I'm in active litigation, not CAPE. Can you still help?
Yes. Protest and litigation refunds can still be purchased. Because CBP may take 12 months or longer to pay, pricing falls toward the lower end of the range.
